These Terms of Service (“Agreement”) govern your access to and use of the flatx. application (“the Application”). By accessing or using the Application, you agree to be bound by this Agreement. If you do not agree to these terms, you may not access or use the Application.
Application Purpose
The Application serves as a marketplace for a network of connections to post and advertise their flats, apartments, or rooms to 1st connections and 2nd connections. flatx. acts as a facilitator, connecting users and enabling them to communicate and transact with each other. flatx. does not own, sell, or endorse any of the listed accommodations. flatx. shall not be liable for any damages, losses, liabilities, or disputes arising from the use of the Application, interactions between users, or any transactions facilitated through the Application.
User Responsibilities
2.1 Eligibility: You must be at least 18 years old and have the legal capacity to enter into a contract to use the Application. By using the Application, you represent and warrant that you meet these requirements.
2.2 Accurate Information: You are responsible for providing accurate and up-to-date information when using the Application, including but not limited to property descriptions, availability, and personal details. flatx. is not responsible for any inaccuracies or misrepresentations provided by users.
2.3 Compliance with Laws: Users must comply with all applicable laws, regulations, and contractual obligations when using the Application, including but not limited to laws related to renting, subletting, taxation, data protection, liability, user management, and prohibited activities.
Booking and Transactions
3.1 User Interaction: flatx. provides an Application for users to connect and communicate. Any agreements or transactions entered into between users are solely between those parties. flatx. is not a party to any transactions or agreements and does not guarantee the accuracy, quality, or legality of listings or the suitability of accommodations.
3.2 User Conduct: Users agree to engage in respectful and lawful communication and interactions with each other. Harassment, discrimination, or any form of abusive behavior is strictly prohibited and may result in the suspension or termination of user accounts.
Liability and Disclaimers
4.1 Application Usage: flatx. does not guarantee the continuous, uninterrupted, or secure access to the Application. The Application may be subject to limitations, delays, and other issues inherent in internet communications.
4.2 Property Listings: flatx. does not verify the accuracy, completeness, or quality of property listings, including availability, pricing, and amenities. Users are solely responsible for verifying such information and making decisions based on their own judgment.
4.3 User Responsibility: Users understand and agree that any accommodations, or interactions facilitated through the Application are at their own risk. flatx. is not liable for any damages, losses, or disputes arising from the use of the Application or interactions between users.
Intellectual Property
All content, trademarks, logos, and intellectual property associated with flatx. and the Application are owned by or licensed to flatx. Users may not use, reproduce, modify, or distribute any content from the Application without explicit permission.
Data Protection and Privacy
6.1 Data Collection and Use: flatx. collects and processes user data in accordance with applicable data protection laws. By using the Application, you consent to the collection, use, storage, and processing of your personal information as outlined in the Privacy Policy.
6.2 Cookies and Tracking Technologies: flatx. uses cookies and similar tracking technologies to enhance user experience. By using the Application, you consent to the use of cookies as described in the Cookie Policy.

Prohibited Activities
Users are prohibited from engaging in activities that violate applicable laws, infringe upon the rights of others, or breach this Agreement. Prohibited activities include but are not limited to fraud, spamming, hacking, unauthorized access, and any illegal or harmful activities. flatx. reserves the right to take appropriate action, including suspending or terminating user accounts, for violations of these terms.
Taxation
Users are solely responsible for complying with their tax obligations arising from transactions conducted through the Application. flatx. does not provide tax advice and is not responsible for any tax-related matters.
Jurisdiction and Applicable Law
This Agreement shall be governed by and construed in accordance with the laws of Germany. Any disputes arising from this Agreement shall be resolved through arbitration or in the courts of Germany.
Modifications to the Terms of Service
flatx. reserves the right to modify or update the Terms of Service. Any changes will be communicated to users, and users will have the opportunity to review and accept the revised terms before continuing to use the Application.
Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
